Service Terms and Conditions

Effective October 15, 2026. Case Water Systems LLC.

1. WHAT YOU ARE APPROVING

Your accepted estimate or work authorization states the work, price or rates, payment schedule, and included materials. These terms must be provided before you approve the work. Only the listed work is included. Specific written project terms control if they conflict with these general terms. You confirm that you have authority to approve work at the property.

2. NO GUARANTEE OF NATURAL WATER FLOW

WE DO NOT GUARANTEE THAT A SPRING OR WELL WILL PRODUCE MORE WATER, A MINIMUM FLOW, A CONTINUOUS SUPPLY, OR ENOUGH WATER FOR YOUR NEEDS, unless we expressly agree to that result in a separate signed agreement.

Repairs, excavation, spring capture, pumps, tanks, and piping cannot guarantee natural source production. Flow measurements show conditions during the test only. Drought, rainfall, groundwater levels, geology, and seasonal changes can affect future flow. Storage tanks and booster pumps do not create source water.

3. EXPLORATION AND REPAIRS ARE PAID WORK

AUTHORIZED EXPLORATION, DIAGNOSTICS, EXCAVATION, AND REPAIRS PROPERLY PERFORMED REMAIN PAYABLE EVEN IF THE SOURCE DOES NOT PRODUCE THE WATER YOU WANT.

Spring exploration may not find a usable source. A repair may correct an equipment problem without increasing natural yield. The authorization must define the work, price or rates, spending limit, and stopping point. Additional exploration, another source, storage, testing, or treatment costs extra when separately approved. This provision does not excuse defective work or an unmet enforceable promise.

4. EXTRA WORK NEEDS APPROVAL

Hidden damage, rock, buried obstructions, failed existing parts, and code requirements may change the work needed. We will explain additional work and obtain approval of its scope and price before proceeding. Approval may be documented by signature, email, text, or electronic change order. We may pause work if approval is unavailable or conditions are unsafe.

5. PAYMENT

Payment is due as stated in your accepted estimate. If no other date is stated, final payment is due when the authorized work is completed and the invoice is delivered. Payment for properly performed authorized work does not depend on increased natural water flow unless your agreement expressly says otherwise. No undisclosed interest, penalty, or collection fee is created by these terms.

6. ONE-YEAR WORKMANSHIP WARRANTY

For one year after completion, we will correct defects caused by our workmanship in the authorized work at no charge. Contact us promptly and allow reasonable access to inspect and correct the problem. Take necessary emergency steps to protect people and property and keep reasonable records.

This warranty does not cover a failure caused by natural source decline, freezing, lightning, power problems, ordinary wear, misuse, missed maintenance, changed water chemistry, or unrelated existing equipment. An exclusion applies only when it caused the claimed failure. Manufacturer equipment warranties have their own terms. Removal, shipping, and reinstallation costs not covered by a warranty require disclosure and approval. Rights that cannot lawfully be excluded remain in effect.

7. CALLBACKS AND MAINTENANCE

Covered workmanship corrections are free. Unrelated failures, maintenance, depleted sources, and additional work may be charged only after fees are disclosed and approved. Follow the system’s maintenance instructions, protect equipment from freezing, and report leaks and alarms promptly. Spring work may release sediment and require more frequent filter changes. Included follow-up visits must be listed in your estimate.

8. WATER QUALITY AND INSPECTIONS

Clear water, restored flow, filtration, chlorination, or UV installation does not by itself prove water is safe to drink. Testing reflects the submitted sample and tested parameters at that time. Treatment performance depends on the agreed specifications, water conditions, operating conditions, and maintenance.

Well, spring, and septic inspections cover only the agreed accessible components and testing. They do not guarantee future operation, hidden conditions, remaining life, or approval for expanded use. Required permits and agency approvals still apply. We do not provide well drilling or bulk water delivery. We do not perform septic pumping directly; when we coordinate pumping with an independent pumper, that coordination will be stated on your estimate or work order.

9. ACCESS AND PROPERTY DISTURBANCE

Provide safe access and disclose known private utilities, buried structures, hazards, and property boundaries. We remain responsible for applicable utility-location and excavation requirements. Excavation disturbs ground and may affect landscaping or drives. Only restoration listed in the estimate is included. These terms do not excuse damage caused by our failure to use reasonable care.

10. PROBLEMS AND LEGAL RIGHTS

Contact us with the property, invoice number, and a description of the issue. Give us a reasonable opportunity to inspect and correct defective work, except where urgent protective action is necessary. These terms do not waive nonwaivable consumer rights or excuse fraud, gross negligence, willful misconduct, or other liability that cannot lawfully be excluded. They do not shorten legal claim periods or override an enforceable express promise. North Carolina law applies to the extent applicable.

11. EXISTING SYSTEMS AND PUMP RETRIEVAL

Our work does not create a warranty on existing equipment or on the entire system. Aging casing, drop pipe, wiring, fittings, valves, tanks, and inaccessible components may fail independently. Pump selection depends on available well records, water levels, testing, required pressure, elevation, and piping. Unknown or inaccurate information may require approved testing or redesign. Before a pump retrieval with known risks, the authorization should state the retrieval method, budget, stopping point, and options if equipment is stuck or cannot be recovered. Additional recovery work, replacement parts, and disposition of unrecovered equipment require specific authorization. We remain responsible for reasonable care and applicable legal duties.

12. TREATMENT LIMITS AND CUSTOMER-SUPPLIED EQUIPMENT

Treatment equipment is selected for the water conditions, flow, pressure, and contaminants identified in the agreed scope. It does not treat every possible contaminant. Changes in water chemistry or demand may require additional treatment. UV operation depends on suitable pretreatment, water clarity, flow, power, and lamp maintenance; it does not remove chemical contaminants. Laboratory turnaround times are estimates, and a single sample does not establish continuing water quality. Consumables and routine maintenance are chargeable unless expressly included.

Customer-supplied equipment requires our acceptance of its suitability before installation. We do not provide a manufacturer warranty on products we did not supply. Our workmanship obligations still apply to our installation. Any additional troubleshooting, removal, or replacement caused by unsuitable or failed customer-supplied equipment requires disclosed charges and authorization.

13. SEPTIC, DRAINAGE, AND PERMITS

Septic repairs are limited to the approved scope and do not guarantee the performance of an existing drainfield or the entire system. High groundwater, saturated soil, excessive loading, blocked lines, and improper use may cause problems beyond repaired components. Inspection findings are not a permit or a guarantee of regulatory approval. Permit applications, engineering, pumping by others, and agency fees are included only if listed. Required permits and approvals must be obtained before regulated work begins. A customer’s authorization does not permit unlawful work.

14. SCHEDULING, ACCESS, AND STOPPING WORK

Arrival and completion dates are estimates unless expressly guaranteed in writing. Weather, emergencies, inaccessible sites, unsafe conditions, permit delays, and unavailable equipment may require rescheduling. We will communicate material changes. Twenty-four-hour emergency availability does not guarantee an immediate arrival or restoration of water by a particular time.

We may suspend work for unsafe conditions, missing required approvals, denied access, or overdue payments under the agreed payment schedule, subject to applicable law and required notice. Before suspension, reasonable measures will be taken to leave the work safe. Additional mobilization or standby costs must be disclosed and lawfully agreed; they are not automatic penalties.

15. PROPERTY, ACCESS RIGHTS, AND RESTORATION

The customer must disclose known shared-source arrangements, access restrictions, easements, boundary disputes, and necessary third-party approvals. We do not determine ownership, water rights, or legal boundaries. Work affecting shared or neighboring facilities requires appropriate authority. Responsibility for permit applications and third-party approvals must be stated in the project scope.

Private utility locating, rock removal, dewatering, hauling, disposal, paving, finish grading, reseeding, and landscape replacement must be identified as included or excluded. Normal excavation disturbance does not excuse negligent damage. Reasonable care, required public utility locating, and applicable safety requirements remain our responsibility. The customer should keep children, animals, and unauthorized persons away from the work area.

16. INSPECTION REPORTS AND RECOMMENDATIONS

An inspection report is an assessment within its stated scope and observed conditions, not a certification that every component is defect-free or that a sale, loan, or insurance requirement will be satisfied. Sampling, flow tests, camera work, locating, and destructive investigation are included only if specified. Limits on access and testing will be documented. Reports identify the intended customer and authorized use; any requested third-party reliance should be addressed in the inspection agreement, subject to applicable law. We remain responsible for performing the agreed inspection with reasonable care.

17. WRITTEN RECORDS AND CONTRACT CHANGES

Keep the estimate, accepted terms, change orders, reports, warranty information, and maintenance instructions together. Document project-specific performance promises and exceptions. These terms do not erase enforceable representations or statutory rights. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Any dispute process must preserve applicable legal remedies. No mandatory arbitration, broad customer indemnity, consequential-damage exclusion, or dollar cap on liability is imposed by this draft; those provisions require tailored legal review before addition.
